One final word about the future U.S. market. Ummm... excuse me Mr. DOJ - Online Poker is legal under U.S. Law. It is the transfer of funds into the hosting site that is illegal.

Seems to me like someone has an implied law here.

Amen and the DOJ back off that the wire act covered poker too. hmmmm

No. Under the terms of our agreement with the U.S. Department of Justice, we will not offer real money online poker in the U.S. until such time as there is regulation and licensing permitting this. The agreement does expressly allow for both PokerStars and Full Tilt Poker brands to apply for such licenses in the U.S. whenever they are offered.

Am I the only US resident who sees this as a significant negative? Maybe some of you are just happy at the prospect of getting your funds back.

You are probably in a tiny minority - because before the above we feared they would never be permitted in our market again under any circumstances.

Probably a minority of about 3 people. There was no way Stars/new FTP was going to offer real money games in the US right now. Doing that would seriously affect their chances of gaining a license when such a possibility becomes available

Be prepared for a chunk of your money to be missing. As with any winnings you get over $1000 the IRS will take their cut.

I think at most the DOJ will notify the IRS of any payments over a specific amount and then the IRS would contact us. Balance simply does not = earnings.

Again, as I posted earlier, the DOJ does not collect taxes, and they don't work for/with the IRS. They're pretty much rival agencies. As Debi said and I said earlier, worst case is they probably hand off a player list to the IRS who may or may not choose to follow up or audit the players with larger balances. But they can't easily distinguish what part of balances are winnings and thus taxable. We can never be 100% certain until we get our money, but I'm willing to bet the IRS will not be involved in payouts.

I don't buy it but if it happened that way I go from $7k down to $200!!!

UNCOMFORTABLE? %$&^%$ they are still pretending online poker is illegal!!!

If they felt that way we would not have received our Pokerstars money back.

Sounds like the difference now is that the Asset Forfeiture Program people are in charge...and quess what? It is in their interest to keep our money.

As a non-US player, I'm really happy that I'll have my money back in 90 days. Hope that all US players receive their money as soon as possible too. Can't wait to come back to FT!

Glad to hear the deal got done after I went to bed 5:00 a.m. Tuesday morning. Will let you know if I get paid by Christmas as that is what I also got from reading the original leaked article.
Half a billion paid to the DOJ, to make things right. Talk about bribery. We have RICO laws here in America. They should be used on the DOJ.

Net deposits > account balances (hence how sites profit, aka rake). This would make them responsible for paying out more. A whole lot more, actually, since tons of $ that were at one time in people's account balances were successfully cashed out before BF

Not to mention the records of money specifically deposited in all the years the site ran would be very difficult to attain and possibly confusing. There's basically no level on which it makes any sense for them to pay out deposits rather than account balances. It would be a ridiculous move

They already are. The reason for the remission applications is to make it a hassle or scare some players into not submitting. There will be MILLIONS in unclaimed funds. Either because people don't know how to apply, they are afraid because they haven't been claiming their winnings or they think online poker is/was illegal, or the process is just too much hassle for smaller BRs. All that unclaimed money will eventually end up in the DoJ coffers.

Where it will quickly and forever go missing. eh?:stickyman

This would be true if they had to pay out everyone who ever deposited obviously BUT they only have to pay out to the ones who request remission. And if they do it based on deposits (and again I don't think they will) that number would almost certainly be smaller than if they do it based on what's in the accounts of those requesting.

Some of us would benefit nicely if they based it on deposits - but they really shouldn't do that.

I made multiple deposits on behalf of Cardschat lol. I also deposited for my sister several times and transferred to her account. It would be so unfair to pay me for those. While it would be awesome for me - I would hate it for others.
