Not a loophole. This provision looks like it will be key if there is ever federal legislation about OLP. It goes towards proving any entity is capable of providing an OLP site.
I'm of the opinion that Stars (in particular) should have fought the BF charges all the way thru court and the Supreme court if necessary, as it would have settled things once and for all. Instead, they settled, and little was really resolved. Recent opinions have favored the issue will become each States responsibility, in which case Stars (or others) could approach the problem similar to how they deal with France
, and I believe Italy. Problem there is that the French, and Italians, apparently do not play against the ROW players
