A single donkament, most definitely. If you play enough volume, and that means several thousands of donkaments at the same stake per year, it starts to be predominantly about skill. But I would not wish that even to my worst enemy.

So.... instead of actually doing any research into this, I'll just ask this here: What ever came of this? Did PS release any 'official' statement on this? Was there a resolution, or is this still pending?

I would have to read all the fine print and dont feel like it, but I am pretty sure Poker Stars - and all other sites as well - state in their TOS that all decisions they make are final and incontestable when it comes to TOS and disputes, so a lawyer wont help. They will say "We have decided" and they will be right.
Feel free to correct me, I dont want to read all the TOS. But there IS something to this effect in most, if not all, poker site TOS.
