I see this as a step in the wrong direction. The more we have single states doing OLP the harder it will be to ever federally regulate it. This is bad news imo.

This will be like where some states are "dry" do you think but there will be more dry states than there is for other stuff?

We do not have to deal with the federal/state stuff so its not something that crosses my mind that much.

Well right now it's only available in NV. So 49 "dry" states. When other states license this or some other company to open in their state they are VERY UNLIKELY to allow players from other states to play against each other. These state by state operations will likely fight against any federal legislation (at the very least they'll fight against any federal legislation where they might have to compete) thus throwing money behind the moralist *****s responsible for the "ban" in the 1st place.

Even if we do end up with some federal legislation I have no doubt that there will be a way for states to opt out and that there will be "dry" states as you say.

Thats awsome! California shouldnt be that far behind. The economy needs the money. It should be legal in every state.

Wow, I'm a legal resident of Nevada and it looks like they're not going to let me play anyway. You have to have a cell phone from a supported provider. My provider, Verizon Wireless, is one of the nation's biggest and most widely recognized provider, yet does not appear to be on the list of approved providers...Hope they fix this.

The one bit of really being wrong to do!!!
Only the account setup and login process have changed. Instead of checking a box certifying they are older than 18, players will have to endure a lengthy account setup process involving a Social Security number and a Nevada address. Only those older than 21 will be allowed to play.

This article hardly has any facts correct so I'd take anything it says as wrong until proven otherwise. The main problem with it's contention that the governor has some bill that will allow him to add other states is that the feds regulate interstate commerce.

Just the idea of providing my social security would make me not want to play if I lived in Nevada. Hopefully more news will come about the site and if it'll even get big enough.

But as of today, no laws or rules are in place to regulate any interstate commerce in the case of OLP. So without anything in place, if Nevada has not specifically prohibited it (sadly I think they did), they could have been accepting all US players to play at their site legally registered and running in Nevada.

Lest you think this is a small issue, think this;

Does your state prevent you from accessing you account from another state? Lets say you were a State employee, and have retired, and get most of your stuff done instate via the internet. You would be able to access your account in that state from out of state. Ex;, you retire from Mn, move to Hawaii, and want to change your permanent address so you get your check.

There are no rules or laws that allow me in Ca, to buy products from Vermont. There is no special compact that Ca. and Vt. have entered into that allows me to buy products from there, here, online.

I should have been a lawyer......:( I am not, (IANAL) but I can use the internet and have not found any of the rules or laws that most seem to think are already in place. This subject seems riddled with rumor and inuendo, and a good example of that is in regards to Ca's position on OLP and what the governor has said. First off, he hasn't said much that can be found via google, and what he has said he said mostly a few years ago. Yet for some reason I read that Gov Brown thinks it is a possible help in an ongoing budget crisis in California.

Perhaps I am no where near as good as I want to think I am about finding specifics via the internet. This is very possible when it comes to law stuff. At least here in Ca, the state made a compact with Lexus Nexus that makes it nearly impossible for me to find the legal papers involved in any court case without being a paid subscriber to Lexus Nexus. This has driven me nuts on many different occasions thru the years. I am not a subscriber to Lexus Nexus.

Actually there are tons of laws that come into place when you purchase products from other states. I mean if what you were saying was true I should be able to buy medical marijuana from CA because it's legal there. Let me assure you that's not how it works.

Bad example WV. There are ample Federal Laws covering marijuana such that the legal case of medical hemp has not been made....yet.

There are no laws which either authorized me or prevent me from buying Maple Syrup from New England other than those that the Dept. Of Agriculture (either Fed or State versions) might have in place to prevent pests spreading.

With some recent DoJ and court decisions, OLP is no longer directly linked with the wire act, and thus sports betting. The closest laws seem to possibly be those used for state lotteries.

While each state does have authority over its own domain, there are few laws regarding how that domain can spread. Texas can not invade Oklahoma physically, but could invade it virtually, and as of now, I can't find laws preventing that.

And FWIW, I would want to egg sites to challenge laws to get them clarified, or new laws writ. It pisses me off some that pokerstars did not challenging the laws under which it was indicted. Had they done so, one way or another, the whole OLP law problems would have been greatly cleared. As is, things are still so murky that no one really has a decent grasp on things.

Also, If I have access to Amazon (example only), and can buy stuff from damn near anywhere, why can't I buy OLP from Nevada? Without legislation I can buy subscription based OLP (WPT) from wherever they run their biz (I think it is Los Angeles, but not positive). There are a few states now that WPT has isolated out of their marketing sphere (Fla. most recently), ande the usual villain of Washington State.

Perhaps the easiest way to convince Legislators at both State and Fed levels would be to get them to vote to shuffle the whole issue off to the ICC. This would seem to shield the Fed legislators from the moral quandary they tend to hide behind, and the State legislators from the special interest shields they hide behind. The ICC does regulate interstate stuff, and seems to be the natural place to regulate and then control interstate, and then worldwide OLP.

But, with a lack of Federal Reg's, well, it's gonna remain unregulated even if the states regulate it. All it will take is one state to say 'Open to all'. Question then becomes, does any state in the Union have the balls to do it?

I remember running into something written before UEGIA which said that party poker was raking in (rake and tourney fees) something like 17 million a day! Making OLP a huge biz. Someone somewhere must have the balls to see this thru court cases and legislation! Where is our white knight? The PPA isn't cutting it. They are not contentious enough IMHO.

Looks like the way they're going to test to see whether you're actually in the State of Nevada while you're playing is by using cell phone tower technology. Verizon apparently hasn't gone along with UltimatePoker yet in giving them what they need for verification. They sent me a verification text. I replied to it properly, but then I got this....

Not sure it's really an "error" on Verizon's part, it could be that they don't feel the need to cooperate with some upstart online poker company in giving them the info they need as far as giving out the location of where the player was texting from.
