Evidently they have lowered it to $400k now lol. It is not the 1st time he has lost that much - he should be negotiating with them instead of spending a fortune suing them.

Interesting I would have thought a grown man should be responsible for his actions drunk or otherwise ,the law suit does not surprise me tho.I guess the casino was kind of douchey as well since they could have cut his alcohol off like any bar would.......scorp

Thing is if he was to win would casino's consider limiting alcohol consumption. I don't think he has a chance of winning though.

SNIP<<<< I don't think he has a chance of winning though.

I wold hope not. But remember the woman who sued McDonald's because she scalded herself with coffee and the cup didn't have a warning on it? (And I believe it's happened to other companies too).

Who'da thunk it?

Pretty interesting actually, I didn't realize the casino was legally obligated to not let over-intoxicated players play

In the article, it stated he is an experience gambler.
In our area, the casino {thunderbird} here offers free snacks, free rides -back and forth and lastly free beers.

And in case they lose then thy get more annoyed and ll lose even more trying to recover the past losses. in both Situation Casino wins..

i still remember in yr 2003 , i once won over 6k ausdollar after getting drunk as i didnt know what and how much i was betting in bacarat.. beofe going to Casino i only had 225 bucks in my wallet . then started drinking and end playing .. guess i was lucky to win that much .. the next mronging when i got up frm sleep at home i found out that ive over 6k AUD in cash in my wallet.. by the way that Money paid for my 2 mths study expense

If you're going to drink and gamble, you should be held responsible. Even if a casino if offering you drinks, it's still kind of ridiculous he is going to try and sue them. I wonder how they actually loaned him money? Like such huge amounts of money? I'd of thought he would of had to of wired money over at least.

Also had he actually won $500k in such a bad state, would he have felt the need to give back the money to the casino for letting him play during this "blackout". We all know casinos offer you free food/drinks to keep your custom and hope you continue playing. If you simply can't handle or drink responsibly and gamble at the same time then don't drink to start with or don't go casino. For someone who is so successful and wealthy, it baffles me how stupid one could be.

Actually the lady suffered 3rd degree burns from the coffee. Have to have multiple skin graph surgeries. Not to mention her actions for suing them were justified. McDonald's coffee is/was at least 20 degrees hotter than the recommended level. The stuff was so hot that it melted her pants to her legs...

Anyway regarding the topic. I can see this going both ways. He may get a portion back based off of them having the responsibility to cut him off while drinking but at the same time the man should be responsible for himself. Drinking or not.

I guess it's similar to the duty of care owed to a publican to ensure a patron doesn't drive off intoxicated. Interesting case but I doubt the plaintiff will be successful

both sides are in the bad, but if this guy is a big gambler he needs to watch out that he doesnt get blackballed from casinos.

I am wondering how much money is he going to spend on layers. And if he is successful or not which casino will allow him to play.

This, especially if there are eye witnesses to his dropping chips, slurring speech and inability to tell the difference between color of chips like they say.

While it sounds like a huge sum, it's not really that much when it comes to high rollers, and casinos do regularly let those high rollers play on credit.

Another recent example has the Wynn extending $200K credit to boxer Antonio Tarver: http://www.cardplayer.com/poker-news/16925-star-boxer-arrested-over-las-vegas-gambling-debts

IMO the casino screwed up on this one, and I won't be surprised if the courts rule in the player's favour. If his lawyer can establish that he really was that drunk and the casino kept giving him drinks (and there'll be security footage that will be able to back that up) then it shouldn't be too hard to prove that the casino broke the rules by letting him play drunk.

You can argue over whether or not that law should be on the books or not (personally I think it's a good thing, you've got to have some safeguards) but as long as it's the law, it seems like he has a pretty good case.

He had a credit line of 250k. He believes because he was intoxicated, they doubled his line to 500k that night.

I beg to differ. Someone like that would be the first one at the counter whining
if the coffee wasn't at the proper temperature.

Hot water at 150 Deg F can cause 3rd deg burns in 2 seconds, but if someone serves me a coffee at 150 deg F ............................................... it's going back, case closed.

Coffee should be brewed at ~ 195 Deg F for the best flavour, it won't reach 20 Deg above that unless under pressure, so with all due respect, I'd like to see the source of that statement.

"McDonald’s operations manual required the franchisee to hold its coffee at 180 to 190 degrees Fahrenheit." Just a sample of some of the details of the case.

Great read, thanks for posting.

Several things though:

She had the cup between her knees while removing the lid to add cream and sugar when the cup tipped over and spilled the entire contents on her lap.

Seriously!!!! In a styrofoam or paper cup, between her knees, and that's McDonald's fault?

  • I stand by my statement that ""IF"" someone served me a coffee that was at a temperature so that it wouldn't cause burns, I wouldn't take it, nor would anyone else who enjoys a cup of black coffee, I don't think
  • In spite of the information presented, I still feel it's an example of the society we live in, where people will take advantage of any situation for the financial betterment of themselves without having to work for it.
  • I would like to see an honest public poll showing what percentage of people think the judgement was stupid and socialistic (as will probably the one coming from the subject of the OP in this thread).

I think many people who are quoted in your link are of the same breed as the "ambulance chasing lawyers".

You ever hear of that bus accident where passers-by helped injured folks off the damaged bus in some city and laid them on the sidewalk whilst awaiting paramedics, ambulances and such? By the time it was over, there were something like 3 times as many people laying on the sidewalk as could possibly fit into the bus.

My opinion - Same thing.
