The luck vs skill debate will rage on, but I think the take away from this is that no matter how much you argue poker is skill, the undeniable level of chance involved makes it gambling under most (if not all) state laws.

I still hate legal briefs. According to what I read there any game, or contest can be considered gambling, and thus subject to the IGBA (Illegal Gambling Business Act).

That should include all professional sports.

The basis being that any contest or game that has an element of chance involved is considered gambling. To remove chance in these endeavors makes the outcome a sure thing, and the only way (IMHO) that can happen in pro sports is if the fix is in.

However, it looks more like the opportunity to appeal this appeal which probably means the Supreme Court is gonna get involved.

It comes down to poker being considered gambling under NY law, and thus subject to the IGBA. So arguing in Federal Court that poker is a game of skill is irrelevant, because poker is gambling under the state law, and even if the Federal Court took the skill argument to heart and didn't consider poker gambling under Federal law, it makes no difference in this case.
