Ok heres the deal, the other night I was playing a tournyment style Texas Holdem game with some friends, well the board read as follows Ah Jh Qh 3h 7h
in my hand I had the 4 of hearts and the other person had the 5of hearts and we both had a Ace kicker... now I would call the hand out that it is a split pot correct? this hand ruined the poker game and ruined the rest of the night due to the other player being a drunk Ahole over the situation because he said that he won cause he had the 5 of hearts and I only had a 4.....

The 5H hand is the winner, Ah Jh Qh 7h 5h beats Ah Jh Qh 7h 4h each players other hole card does not matter since they are not a heart.

But why wouldnt it come down to the kicker with the best hand being the ace of hearts?

No. It's the higher flush (counting all cards) that wins.

But why wouldnt it come down to the kicker with the best hand being the ace of hearts?

Because the 5h hand is a bigger flush than the 4h hand. Both hands are tied for the 1st 4 cards and the 5th heart in each hand breaks the tie. If the board had any heart other than the 2h or 3h only then would it have been a chop.

Ok well I just figured the best flush is ace high flush. and both had ace kickers so thought split pot.

Kickers don't count with a straight, flush or full house. You already have a 5 card hand.

The hand would look like this. If you were to look at the best 5 cards it will mean his 5h is higher than your 4h using the beast five highest cards.

You must use 5 cards when making a hand, last time I checked a flush required 5 cards of the same suit.

A) there is no kicker
B) 5 > 4
