Do I have to fold here?

Villain's Fold to Cbet stat is 47% so I thought he may be calling with overcards. Perhaps even AJ just to be a kick in the teeth. Or maybe he's hit a set or straight and was just waiting for my Cbet. Given he's short stacked and he's min raised me on the turn, am I right in thinking he's better off than I am here?

Also, as played, is this ok?

I think this is a fold tbh, he can be doing this with worse TPs but there are way more nut hands that do this.

Villain raise c-bet% would be handy here, more handy than AF.
I shove given villains low FCB he will have alot of Ax floating that flop and he is very unlikely to flat a set or straight on a board this wet then just minraise it. The hand I'm scared of is AJ but can see a short pushing alot of 44/66, the bet sizing is also pretty scary but ye top pair against someone who has plenty of draws in his range and is unlikely to hold monsters seems good enough to me.

Please don't cbet this flop, especially vs. someone who only folds 47%. His fold to 3b will be wayyyyyy lower on this board especially since his preflop range is already probably semi-tight given you open CO and he flat BB. As played not sure if you had AJ I think it's an easy call sucks with KJ since he can have AJ a lot then maybe some sets and maybe some spades. I don't think it makes a huge difference what you do I probably just fold though without reads.

If you didnt have the Js I'd lean towards shove but since it takes all Jx of spades hands out of his range I cant really see what hed be min raising that turn with that you're in good shape against...and theres not many river cards that you'll be able to fold for his last 2 bucks to...I'd say fold is probably the right play as much as it hurts to do so
