I remember when I was in NY I use to go to Manhattan to play poker .... It was a decent poker room, quite flamboyant and well put together but not quite a casino..... I was only privy to this game due to an apparent 'exclusive invite' by a guy that I had met whom happened to be a dealer there. I remember him telling me the first time 'our games are not to be loosely advertised'. Anyways, I am just here reflecting and wondering if it is legal to play poker in the state of NY? This was more of a home game setting regardless of how fancy it was setup....and also aren't there Casino's there?

its legal to play live in NY at any house or club as long as there is no rake.

There is a casino out west near Syracuse called Turning Stone. Its on an indian reservation which is how its allowed.

There will be 4 more casinos opening in the next few years off indian land.

Ah yes, Turning Stone...I was trying to remember that name....because it was just about the only casino I heard advertised by the media to be in NY...I had alway wondered if it was, thanks.... As for the 'no rake', I had to pay 2 dollars every half an hour to continue playing (when the dealers when being changed), besides that no rake when taken from the pots...Oh, I guess it was just 'one of them games'

or a chance to play in a 500$ buy in for 40$. If your in the western new york area i would suggest it

The grey area of NY law is that a 'card club' may charge a membership fee, a seat fee (which could be time based) and other fees. As long as there is no rake or per hand fee, the club should be OK. Where so-called clubs get into trouble is all the extra cirruclar activities that take place, drugs, booze, bookies, etc.
