At our local pub game last night i was in the bb with pocket 8s. It was folded to the short stack in Mid postion. He shoved, at this moment the player opposite me gathered all burnt cards together including mine into the muck. I was aloud to retreave my cards and call, i won the pot and he was out. Was this technically correct ? or should have my cards stay mucked. We all take turns in dealing but the guy opposite wasn't dealing at the time.

Start using a card protector.

First thing is that you should be protecting your cards, either with your hands or some type of card protector. But yes, like spunka linked to, Oz is also a dealer(at least I know he used to be).

You can use a chip as a card protector, that's all I ever use.

Having seen this happen before and having it happen to me ONCE,
I never take my hands off my cards until I fold or the hand is over.

Card Protectors are fine, until you forget to bring them to the table.

Just my 2¢

I think it's his fault to muck it, but as long as it has been mucked and gathered cards together, why can you still call your card back?

Actually you should protect your cards with your stack...

There was another recent thread about mucked cards. Here's the thing, you are responsible for your cards, not the dealer. So it's up to you to protect your hand. I usually use my "lucky" 50¢ piece to cap my cards. As I said in the other thread, in a pinch I will take off my watch and use it to protect my cards. I know alot of people don't where watches anymore, but you can use anything, your zippo, your car keys, anything. It's better safe than sorry. I've seen it happen and heard enough people say it happened to them to learn from their misfortune.

In a home/pub game, I guess it would be up to the players to come to some sort of agreement that satisfies everyone. If none of you are professional dealers then mistakes are bound to be made from time to time. I would say this though, no player other than the designated dealer for the hand in progress should be handling the cards. In most casinos they will allow your cards to be returned and play to continue if your cards are retrievable from the muck. However, they will generally only check the top two cards to see if they are the cards you claim to have been dealt. Since cards are most often swept into the muck and not placed neatly on top of it, they end up somewhere in the middle of the pile and are usually unretrievable. That's why it is better to be safe. Protect your hand by capping your cards.

I usually use a chip to protect my cards but I need to find myself a lucky mascot :)

your hand is most likely dead, but its a bar game so its all good. i use my hand like a claw and lock dem cards up tight.

I have a question about card protectors. Assuming you use a chip as a card protector and the dealer still sweeps your cards into the muck (due to not noticing the chip), is your hand still declared dead as per the once touch muck, dead hand rule that applies in most casinos?

When I first started playing live I was playing the 1-2 NL cash and the dealer had to keep telling me because I was sitting next to him that if any player folds there hand and there cards hit mine then my cards are dead so use a chip or something to protect my hand. It doesn't sound like anyone thru there cards on yours and the player just grabbed your hand by mistake so I would say that you could retrieve your hand and play.

If it's obvious which cards were yours, they may be retrieved.

I don't have much add on this, but personally, my hands never leave my cards until I fold or the current hand is over. I'm glad you were able to continue play, but watching IntenseHeat's video is heart wrenching. I hope it never happens to any of us again!

I seen the same thing in the world championship a couple years ago, and the player wasn't allowed to retrieve their cards.

Even James Bond (although he splashes the pot all-in) knows to keep his hand on the cards. He even moves them away from the dealer when he goes all-in.

Bad guy... just uses a chip... :rolleyes:

Chip or protector will usually keep two cards away from the muck. Playing stud is where I have seen cards go in by accident and it is hard to distinguish if they do and you are normally SOL then.

As everyone has already said, you must pay attention to your cards. Put your hand over them if you do not have a chip or a card protector over it..

Being said that you are responsible for your cards I beleive that the dealer also has the responsibility of paying attention to what is going on in the game.. Very unfortunate when this happens.

Good thing it worked out for you.. If i was the other guy I would have been mad and claimed that it was rigged lol.

You dont need any special card protector, just use one of your chips and put it on the cards :) And, as someone wrote before, If there is obvious which cards was yours and can be retrieved then its possible to bring them back to you and you can play...

Looks like that brief second she used her hands to adjust her chair is when the dealer did it. Her cards should have been at least tight against the edge of the table. Plus the dealer had to reach around behind her chips which should have been a clear sign that something wasn't right.
