i was playing in a home game and called a guy to the river, we where 3 guys in the hand.
one guy made a bet in the river, the next guy folded, i was thinking my action and the guy beting muck his hand. i was the only guy standing whit cards in his hands, so i proceded to take the chips and all hell broke loose.
to me, when the guy mucked his hand it is automaticaly dead, the guy allegued that he did not see me in the hand, so the rule is what exactly.

Technically you were right, as soon as he mucked his hand his hand is then dead. Home games are usually run not like a casino so there is some lenience but that is up to who's game it is, that person should have stepped in and said what is what.

The guy mucked his cards, it's your pot! You should have stood up for what's right. If someone comes to my house, and I would have unusual rules I would let everyone know before the game started.But I would not have unusual rules.

If you want to enforce such rule, then dont call it home game anymore. Its more like ilegal casino at your home.

If it was possible to safely identify the cards he mucked, then at home game, he gets his card backs. And mostly its quite possible.

All 3 of the previous replies bring up valid points. The pertinent information can be boiled down to a few facts:
a. Did you call the bet (either verbally or by forward motion of your chips?
b. Were you given ample opportunity to do so?
c. Were your cards on the table and in a location that the "angry mucker" could have seen them had he been paying attention?
d. How do you define the moment when a hand is mucked or dead? (I am assuming that by whatever definition you use that his hand was indeed dead)
e. And as this was a home game, were all parties acting in good faith - namely you?

Personally I would say the hand is yours if you acted in good faith.

However if you had no real intention of calling until you saw the golden opportunity when the hand was mucked and/or you were intentionally hiding your cards hoping for the outcome that eventually came to pass. You are "that guy"

Every regular home game has one of these two types of guys. Either You are a bad faith opportunist, or your opponent is the angry mucker and i hope you got the pot.

Muck rule should rarely if ever been enforced at a home game i.e a non-commercial game played with family/friends. Simple reason is goodwill. Everyone's there for fun and games and it's not supposed to be serious per se.

However, if this particular 'home' game is actually a underground poker den in disguise, then yeah if im running it, i'll definitely keep the muck rule enforced.

well i call it a house game because is not a casino
is a private club where we have a poker table where any member can sit down and in order to keep it dair we aply vegas rules in every aspect.

Usually a good idea to set these rules before hand. At least set a precedent.

My home games are usually small stakes and a reason for the guys to get together and drink beer, talk sports, and eat wings. Small issues like this are usually just voted for the best interest of the game.

Technically you were right its your hand.
But also when you play home game there is depends on home rules.
If am in ur situation, and I play home game with my friends and this situation happened if I call the river I will let him take the cards again.
But when you play at casions is dead hand of course! and is the only rule.

Split the pot next time so no fight breaks out! But I agree with you, he should pay attention to the game and the fact that he mucked...pots yours

every poker should know to protect their hand until they have the chips pushed to them. i never take my hands off my cards until the chips are heading my way and all other hands have been mucked. the rule is if your hand has been mucked your hand is dead

home game or not, rules are rules, but home games might have more alcohol involved so making mistakes like that should be forgivin
