| But Kentucky is different... ...I mean in the way they treat online gambling, including poker. Under the legal system set up in the United States, gambling is a 'state concern', meaning that different states have the right to regulate gambling within their borders differently from other states. Federal law cannot generally pre-empt state law, if the state law is crafted properly. Insurance and real estate law are also areas of the law in which the 50 states can craft their own laws and regulations. So in Kentucky, I believe that there IS legal liability for an individual to even play poker online. But that is the only state where that exists, as far as i know. I'm a lawyer, but gambling is not my legal specialty. I would definitely want to make it my recreational specialty. That's why I like this site! |

| Is Online Poker Illegal in your State? I believe that this is still current!! Currently there are considered to be no Federal laws which prohibit US citizens from playing poker online, but certain States have implemented laws to prohibiting gambling over the internet. The only state where it appears to be 100% certain that online poker is illegal is the State of Washington. I don't know about Kentucky! Illinois, Indiana, Louisiana, Michigan, Nevada, New Jersey, New York, Oregon, South Dakota, Washington, Wisconsin. Peace, FLOW |

I live in Michigan, supposedly one of the illegal states. Some networks and US poker sites are closed, like Prima and Doyle's Room, but PS, FT, Carbon, Bodog and others are still up. So are UB and Absolute, although they should be boycotted by all players. The frustrating thing about the Michigan prohibition is that I went to the state website where laws are published and found NO law prohibiting online poker. Ask somebody at Doyle's Room what law they are referring to and they give a non-answer. So sites are operating under paranoia and rumors rather than real legal research. I'd really like to know if and where people in Washington and Kentucky are playing. |
