So i've been searching for the last hour, fulltilt now does this e instacheck thing now that seems to be very easily tracked. does anybody use this and know how safe it is or do you just take the legal risk?

I'm not an attorney, however the UIGEA is targeted at regulating financial institutions, not consumers. You are taking no extraordinary risk by depositing via e check.
